Terms of Use

These Terms of Use set out the rules for using the hurteks.pl website and the general conditions for contacting and engaging in commercial cooperation with Hurteks Sp. z o.o. The website is informational in nature and is directed at businesses engaged in economic activity.

1.General Provisions

The owner and operator of the website is Hurteks Sp. z o.o., with its registered office in Warsaw at ul. Juliana Smulikowskiego 4A lok. 21, 00-389 Warsaw, entered in the register of entrepreneurs under KRS number 0001203396, NIP 5252961310, hereinafter referred to as the Service Provider.

Using the website constitutes acceptance of these Terms of Use. The Terms of Use are made available free of charge in a manner that allows them to be obtained, reproduced, and stored.

2.Definitions

• Website. The website available at hurteks.pl together with its subpages.
• Service Provider. Hurteks Sp. z o.o.
• User. Any person using the Website.
• Contractor. A business entering into commercial cooperation with the Service Provider.

3.Scope and Nature of Services

The Service Provider conducts business in the wholesale and international distribution of optical fibre, fibre-optic cables, and FTTx components. The Website serves to present the offer, establish contact, and provide information about the Service Provider.

Information, product descriptions, and price lists published on the Website do not constitute an offer within the meaning of Article 66 of the Civil Code, but an invitation to enter into a contract within the meaning of Article 71 of the Civil Code. The terms of any specific transaction are agreed upon individually.

Services provided electronically

Through the Website, the Service Provider provides the following services free of charge by electronic means:

• making available informational content about the Service Provider and its offer,
• a contact form enabling the submission of enquiries,
• a newsletter, if available, provided upon the user’s consent.

Conclusion and termination of the electronic services agreement

The agreement for the use of the Website is concluded at the moment the user begins using it and terminates when the user leaves it. The agreement for the newsletter service is concluded upon confirmation of subscription and may be terminated at any time by unsubscribing. Use of the contact form is a one-time event and ends upon submission of the enquiry.

4.Technical Requirements

Using the Website requires a device with internet access, an up-to-date web browser, and cookies enabled to the extent necessary for the Website to function. The rules on the use of cookies are described in the Cookie Policy.

5.Rules of Use

The User is obliged to use the Website in accordance with the law, good practices, and these Terms of Use. It is prohibited to provide unlawful content or to take any action that may disrupt the proper functioning of the Website.

6.Intellectual Property Rights

All content published on the Website, including texts, graphics, trademarks, the HURTEKS logotype, and the layout of the Website, is the property of the Service Provider or is used on the basis of appropriate authorisations and is protected by law. Use of such content without the Service Provider’s consent is prohibited.

7.Liability

The Service Provider makes every effort to ensure that the information on the Website is up to date and accurate, but accepts no liability for the consequences of decisions made solely on the basis of the Website’s content. The Service Provider is not liable for interruptions to the Website’s operation resulting from technical reasons or reasons beyond the Service Provider’s control. In relations between businesses, the Service Provider’s liability is limited to damages caused by wilful misconduct, to the extent permitted by law.

8.Complaints

Complaints regarding the operation of the Website may be submitted to office@hurteks.pl. The submission should include contact details and a description of the matter. The Service Provider will handle complaints within 14 days of receipt and will communicate the outcome by electronic means.

9.Personal Data

The rules for processing the personal data of Users and Contractors are set out in the Privacy Policy.

10.Governing Law and Jurisdiction

Matters not regulated by these Terms of Use are governed by Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services. The court with jurisdiction to resolve disputes is the court with jurisdiction over the Service Provider’s registered office.

11.Final Provisions

The Service Provider reserves the right to amend these Terms of Use for good cause. The current version of the Terms of Use is always available on the Website. Amendments take effect upon their publication, unless a different date is specified.
